
COPYRIGHT POLICY
This Copyright Policy (the " Policy ") represents LIVESNAP TECHNOLOGIES INC.'s (" LIVESNAP ", " we ", " us ", " our ") commitment to respect and enforce the intellectual property rights of third parties.
LIVESNAP will terminate access to the LIVESNAP market intelligence platform (the " Platform ") and/or the services offered on and through the Platform (the " LiveSnap Services ") to users who infringe the copyrights of third parties through access to or use of the Platform and/or the LIVESNAP Services.
NOTICE OF ALLEGED VIOLATION
If you are a copyright owner or an agent thereof and believe that any material/content displayed or operated through the Platform and/or the LiveSnap Services infringes your copyright, you may submit a notice to that effect in accordance with this Policy by sending the following information, in writing, to our designated agent (see information below):
- A physical or electronic signature of the owner or of a person authorised to act on behalf of the owner of an exclusive right allegedly infringed;
- Identification of the copyrighted material claimed to have been infringed, or, if multiple copyrighted materials on the Platform or within the LiveSnap Services are covered by a single notice, a representative list of such content on the Platform or available within the LiveSnap Services;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to it which is to be disabled, and information reasonably sufficient to permit LIVESNAP to locate the material or content;
- Information reasonably sufficient to permit LIVESNAP to contact you, such as an address, telephone number and, if available, an email address at which you may be contacted;
- A statement by you that you believe, in good faith, that use of the material or content involved in the complaint is not authorized by the copyright owner, its agent, or applicable law;
- A declaration that the information contained in the notice is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right allegedly infringed.
We also recommend that you consult your legal advisor in advance to assist you in such matters.
Without limiting the foregoing, you acknowledge that a notice of claimed infringement that does not comply with this Policy and the procedure set forth above may be invalid and that any person who misrepresents any material or content or other activity as infringing may be subject to legal action against such person.
NOTICE OF NON-VIOLATION
If you believe that your material or content available via the Platform and/or on the LIVESNAP Services has been removed (or access to which has been disabled) does not infringe any third party's intellectual property rights, you may send LIVESNAP a notice of non-infringement.
To be effective, this notice of non-infringement must be a written communication provided to our designated agent (see information below) containing the following information (we also recommend that you first consult your legal counsel for assistance in this matter):
- Your physical or electronic signature;
- Identification of the material or content that has been deleted or to which access has been disabled and where the material or content appeared before it was deleted or access to it was disabled;
- A sworn statement that you believe, in good faith, that the material or content has been deleted or disabled due to an error or misidentification of the material or content;
- Your name, address, telephone number and, if available, an e-mail address, together with a statement that (i) you irrevocably consent to the exclusive jurisdiction of the courts of the judicial district in which your address is located or, if your address is outside Canada, to the exclusive jurisdiction of the courts of the Province of Quebec, District of Quebec;
- and (ii) you will accept service of process from the person who provided the notice of alleged violation or from an agent of that person.
You acknowledge that a notice of non-infringement that does not comply with this Policy and the procedure outlined above may be invalid and that any person who materially misrepresents that material or activity has been removed or disabled in error or as a result of misidentification may be subject to legal recourse.
If a notice of non-infringement is received by LIVESNAP's designated agent, LIVESNAP may send a copy of the notice of non-infringement to the original complaining party, informing that person that LIVESNAP may replace the removed material/content or cease disabling it within ten (10) business days thereafter.
Unless the copyright owner files a lawsuit seeking a court order against the provider of the material/content or the user of the material/content, the removed material/content may be replaced, or access to it restored, within ten (10) to fifteen (15) business days or more after receipt of the notice of non-infringement, in LIVESNAP's sole and absolute discretion.
