Livesnap offers market intelligence services for businesses.

The General Privacy Policy applies to Livesnap's corporate clients and to visitors to its website.

Definitions

In this Privacy Policy of Livesnap Technologies Inc. the company operating the Livesnap website and Platform (referred to as " Livesnap "):

The Platform is the market intelligence software created and marketed by Livesnap Technologies Inc.

Personal Information refers to information that makes it possible to identify a person, directly or indirectly. This does not include Business Details, except in cases where privacy laws deem them to be Personal Information. Anonymized information within the meaning of the law is not Personal Information.

Business Details is information that relates to the performance of a function within an enterprise, such as an individual's name, title and function, as well as the address, email address and telephone number of the individual's place of work. By "the performance of a function", we mean that this information must have been collected, used or disclosed for the purpose of communicating with the individual in the course of his or her employment, business or profession.

Customer means a customer of Livesnap who is a business or other organisation and who is not a Consumer. The Customer creates an account and uses the Livesnap Platform to obtain market intelligence services.

Consumer means the individual whose Personal Information may be disclosed to Livesnap for the purpose of performing its services. The Consumer's Personal Information may also be collected by Livesnap in the course of its market intelligence activities. For the purposes of this Policy, the term "Consumer" specifically excludes the Visitors to the Site. To learn more about our practices regarding Personal Information of Site Visitors, please carefully read the following section: "Our commitments to Visitors to our Site".

Customer Personal Information means Personal Information entrusted to Livesnap by the Customer and may include Consumer Personal Information. This information may include, but is not limited to: last name, first name, title or function, company, event related to a person.

Scope and Application

This Policy applies to Livesnap's Customers. It also applies to Customer Personal Information that has been entrusted to Livesnap for the purpose of providing contracted services, including Customer Personal Information in the possession of Livesnap's service providers.

If you are a Visitor of the Livesnap Site, please read the following section carefully : "Our commitments to the Visitors to our Site".

Livesnap's employees, subcontractors and agents must comply with the Confidentiality Policy if they have access to the Customer's Personal Information or Personal Information in the course of their duties.

Personal Information Protection Program

In order to protect Personal Information, including Customer Personal Information, we have implemented policies, practices and procedures relating to the management of Personal Information in our possession or custody. These internal policies and procedures govern the collection, use, disclosure, retention and destruction of Personal Information, as well as the handling of complaints, information security and data governance. These policies and practices also provide the framework for the implementation of privacy impact assessments, as well as the prevention of and response to potential privacy incidents. All these policies and practices have been approved by our Privacy Officer. The collection of Customer Personal Information via our Platform complies with the requirements of this program.

Person Responsible for the Protection of Personal Information

Livesnap's senior management has delegated the management of the privacy program to the Privacy Officer. The Privacy Officer's role is to internally manage and monitor Livesnap's privacy program. The Privacy Officer approves and implements privacy policies and procedures, ensures that they are working properly and reports to Livesnap's senior management on the effectiveness of the program. The Privacy Officer is also responsible for providing the necessary support in the event of a question, complaint or request relating to the protection of Personal Information. We do not have a direct business relationship with the Consumer. For this reason, we require our Customers to ensure that they have obtained all mandatory consents from the Consumers whose Personal Information they provide to us. This requirement also applies to the Personal Information of minors, which may be entered on the Platform. In particular, Consumers should have consented to their Personal Information being managed by Livesnap in accordance with this Privacy Policy, unless otherwise permitted by applicable law. We also require our Customers to provide the notices required by law to Consumers and to ensure that the use, collection or communication of Personal Information between Livesnap and the Customer is authorized.

Collection and Use

Livesnap obtains possession of the Customer's Personal Information when the Customer creates an account on the Platform. As a result, Personal Information may also be collected for Livesnap for the specific purposes listed below.

When we develop and improve our product, we make sure to limit the fields of collection of Personal Information to what is strictly necessary for the operation of the Platform and to what is requested of us by the Customer within the framework of our contracts, to enable the Customer to achieve its objectives.

Similarly, we require our Customers to limit the sharing of Customer Personal Information in Livesnap's custody to that which is necessary for our market intelligence services. We also require that the same limitation apply to the sharing of Personal Information for the purposes identified in this Privacy Policy as well as to comply with any contracts entered into between Livesnap and the Client.

The purposes for which Livesnap collects and uses Personal Information and Customer Personal Information are as follows:

  • To establish and maintain a commercial relationship with our Customers;
  • To develop, improve, promote or provide products and services to our Customers, including for diagnosing technical problems or improving functionality;
  • To maintain and improve the security of the Platform;
  • To meet contractual, legal and regulatory requirements;
  • To investigate and resolve incidents;
  • To support our Customers in exercising their consumer rights or resolving disputes;
  • For the supply of products and services on behalf of Customers (in accordance with the contracts entered into between Livesnap and the Customer);
  • For any other purpose permitted by law, in particular to respond to requests from police authorities or governments.

Communication and Transfer of Personal Information

Livesnap only discloses or transfers the Customer's Personal Information where required or permitted by the contract with the Customer or otherwise required or permitted by applicable law.

Livesnap may from time to time need to share Personal Information with its subcontractors or agents to help us make available all the features of our Platform and Site (maintenance, analysis, legal requirements, fraud detection, marketing and development). They will only have access to Personal Information that is necessary to perform these tasks on our behalf and they are required not to disclose or use it for any other purpose.

Please note that these subcontractors or agents may be located in Canada or in other jurisdictions or countries. Please be aware that we have contractual agreements with these subcontractors to ensure the security of the data we entrust to them and that we conduct privacy impact assessments before disclosing any Personal Information outside the province of Quebec. Although the Personal Information we transmit is protected by appropriate security measures, Personal Information may be made available to foreign government agencies under applicable laws.

Conservation

Livesnap has established retention periods for Personal Information in its custody. Livesnap will retain Personal Information only as long as it remains necessary or relevant for the identified purposes, unless otherwise required by contract with the Customer or by legal or regulatory requirements. Once these periods have expired, Livesnap will return or destroy the Personal Information in accordance with the contract with the Customer or its internal policies for the management of Personal Information.

Safety Measures

Livesnap makes the security of the Personal Information it collects, uses and retains a priority. Accordingly, Livesnap ensures that security safeguards appropriate to the sensitivity of the data are in place to protect Customer Personal Information against such risks as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction.

Insofar as it is possible and applicable within the scope of our services, Livesnap implements, maintains and monitors technical and administrative measures to help protect the security, integrity, availability and confidentiality of the Personal Information we collect or have in our custody.

Accuracy

Livesnap relies on the Customer to ensure the ongoing accuracy of the Personal Information and Customer Personal Information that Livesnap collects, uses and retains for the purposes set out above.

Incident Management

Livesnap's privacy program includes incident detection and response practices and procedures designed to facilitate the prompt reporting to the Customer of incidents involving the Customer's Personal Information.

As the Customer's Information belongs to them, the Customer is generally responsible for managing and following up security incidents with End Users. In accordance with its contracts with the Customer, Livesnap will provide reasonable assistance to support the Customers in investigating the incident and complying with their obligations, for example in relation to notifications to affected individuals (including Consumers) and reporting the incident to the relevant privacy commissioners or other relevant parties.

Access to Information and Similar Rights

Since we do not have a direct business relationship with the Consumer, Livesnap will generally refer requests for access to information, correction of Personal Information or other such requests from Consumers to the Customer, unless Livesnap has contracted to do so with the Customer as part of its provision of services.

Our Commitments to Visitors on our Site

This section describes Livesnap's personal information handling practices when you visit our Website (www.livesnap.com).

The rights and obligations described in this section do not, however, cover third party websites which may be linked to our Site or which are mentioned on the Site. These third party websites have their own privacy policies. This section applies only to the Site, and not to the Platform.

Please note that visiting and using our Site and Platform is also governed by our Terms of use.

By using our Site and agreeing to our Terms of Use, you consent to the collection, use, disclosure and retention of your Personal Information in accordance with this section of the Policy. We collect your information directly from you, with your consent, except where permitted or required by law. If you do not agree with this section, please do not use the Site.

Collection

When you visit our Site, certain Personal Information may be collected automatically or voluntarily, depending on how you interact with the Site. This information may then be used in accordance with the purposes described below.

Information collected automatically

Our web servers automatically record certain technical information relating to your visit, such as your IP (Internet Protocol) address, the page you are visiting, the date and time of your visit and your approximate location.

The IP address is a series of numbers assigned to your device by your Internet service provider. Although it cannot always be used to identify a person directly, it can sometimes do so when combined with other data. For this reason, we consider the IP address to be Personal Information.

Information you provide voluntarily

We also collect Personal Information that you choose to send us, for example when you fill in an online form. This may include registering for a newsletter, requesting a demonstration or requesting general information. We collect only the information necessary to respond to your request.

Minors

We do not voluntarily collect Personal Information from children under the age of 14. If you are under 14, please do not send us any Personal Information without the express consent of your parent or guardian.

If you are a parent or guardian and believe that your child has provided us with Personal Information, we invite you to contact us. If we discover that we have collected such information without verified parental consent, we will take steps to delete it from our systems.

Use

We collect, use and disclose your Personal Information only for the purposes stated at the time of collection, or where permitted or required by law.

These purposes may include:

  • To process your requests for products, services or information, and to communicate with you in this regard;
  • Respond to your support or customer service requests;
  • To develop our activities and promote our services, for example to inform existing or potential customers of new offers, with your prior consent;
  • Comply with our legal and regulatory obligations;
  • Any other purpose to which you have expressly consented.

Communication

We will only disclose your Personal Information to authorised persons or organisations, and only in the situations provided for by law or described in this section.

This can include the following cases:

  • Service providers

    We use service providers to help us offer, manage and improve our services. These suppliers may have access to your Personal Information only to the extent necessary to carry out their mandates on our behalf (for example: data hosting, technological tools, advertising services or customer support). Some of these suppliers may be located outside Quebec or Canada. Where this is the case, we take the necessary measures to ensure that your Personal Information is adequately protected, in particular by requiring contractual commitments that comply with applicable laws.

  • In the event of a company transfer

    If we sell, buy or reorganise some or all of our business, your Personal Information may be one of the transferred assets. In that event, your Personal Information will continue to be protected in accordance with our legal obligations and this section.

  • In anonymized form

    We may communicate certain information in a form that does not allow you to be identified (for example, for statistical purposes or to identify trends).

Preservation and Destruction

We retain your Personal Information only for as long as is necessary to fulfil the purposes for which it was collected, or to comply with our legal obligations. The retention period may therefore vary depending on the nature of the information and its use.

When we act on behalf of our customers, we comply with their instructions regarding the length of time we retain data, within the limits permitted by law.

Once the information is no longer required, we destroy it in a secure manner to ensure confidentiality and prevent unauthorised access.

If you have an account with us, you can request its deletion by contacting our Privacy Officer. We will handle with your request within a reasonable time.

Security

The security and confidentiality of your Personal Information is important to us. We have put in place rigorous measures to protect your Personal Information against loss, theft, unauthorised access, use, disclosure or modification.

Our security measures include :

  • Organisational measures , such as limiting access to Personal Information to only those people who need it to carry out their duties;
  • Physical measures, where applicable, such as the protection of equipment used in the course of our activities and the secure storage of back-ups;
  • Technological measures , including the use of strong passwords, data encryption, firewalls and regular system updates.

We also carry out periodic risk assessments and audits to ensure compliance with our confidentiality and security practices.

Your Rights

Under applicable law, you may exercise certain rights in relation to the Personal Information we hold about you. For example, you may:

  • Request correction of inaccurate, incomplete or ambiguous information;
  • Requesting the deletion of certain Personal Information;
  • Withdraw your consent to the collection or use of your information, where such collection is based on your consent (for example, for promotional communications or non-essential cookies);
  • Obtain information on the categories of persons to whom your information has been disclosed, if applicable;

In accordance with applicable laws, you can control the automatic collection of certain information, in particular by managing cookies. If you choose to receive our newsletter, news, competitions, promotions or other information about our services, you can withdraw your consent at any time by following the instructions provided in our emails or by contacting our Privacy Officer.

Use of Cookies, Marketing Preferences and Online Advertising

Your Marketing Preferences

We may use the Personal Information you provide to send you marketing communications, such as newsletters, promotions or targeted advertising. You always have the choice whether or not to accept these communications.

Electronic communications

You can opt-out of receiving marketing communications from us by clicking on the unsubscribe link in our emails or by emailing us at privacy@livesnap.com. If you unsubscribe, we will no longer send you marketing communications, but we may continue to send you messages relating to the administration of our services.

Personalised advertising on mobile devices

We may use your mobile advertising ID (e.g. IDFA on iOS or AAID on Android) to personalise the ads you see. You can manage or disable this feature in your device's privacy settings, or reset your ad ID.

Use of Cookies

When you visit our Site, cookies may be stored on your device. These small files enable the Site to function properly, analyse performance and sometimes personalise your experience.

The term "cookies" also includes other tracking technologies, such as web beacons or tracking pixels. All Personal Information collected by these means is treated with the same level of confidentiality as other Personal Information we hold.
